1. What these terms cover
These Terms of Service (“Terms”) govern your use of the nextscalp.com website and of either NextScalp product:
- NextScalp Bot - the @nextscalp_bot Telegram bot, used on a free or paid subscription tier.
- NextScalp Journal - software you buy once and host yourself.
By starting the bot, by buying either product, or by using this website, you agree to these Terms. There is no checkbox at checkout: starting the bot or completing a purchase is your acceptance. If you do not agree, stop using the products and, if you have an active Bot subscription, contact us to arrange cancellation.
Buying or using one product does not require the other. They are sold separately, on different terms, as set out below.
2. Who we are
Both products are operated and sold by NextScalp, an independent trader based in Warsaw, Poland. NextScalp is operated by an individual rather than a company, so there is no company registration number to quote. In these Terms, “we,” “us,” and “our” mean NextScalp, and “you” means the person or organisation using or buying a product.

3. Not financial advice
Nothing produced by either product is financial advice, investment advice, trading advice, or any other professional advice. Alerts, AI output, coaching, statistics and labels are informational only. They reflect algorithmic analysis of market data or of your own past trades; they do not account for your financial situation, risk tolerance, tax position, or regulatory constraints.
- You are solely responsible for your own trading decisions.
- Past signal performance and past trading results do not guarantee future results.
- Crypto perpetual futures trading carries a high risk of loss, including losing more than your initial margin. Trade only what you can afford to lose.
- The AI features in both products are a second opinion, not an instruction to enter or exit a position.
4. Eligibility
You must be at least 18 years old to use either product. By using them you confirm that you are of legal age in your jurisdiction to enter into binding contracts, that using crypto trading tools is legal where you are, and that you are acting on your own behalf. If you are in a jurisdiction where distributing crypto trading signals or related services requires a licence we do not hold, you are not permitted to use the products.
5. No trading, no custody
Neither product executes trades, moves funds, or holds your assets.
- The Bot never asks for exchange API keys. It reads public market data and sends you messages; you place every order yourself.
- The Journal reads your own fills through an API key you generate. Read-only access is recommended, and the software never needs trading or withdrawal permissions. You are responsible for how you scope and store those keys.
6. NextScalp Bot: what the service is
The Bot is a real-time market-screening tool that monitors Binance USDⓈ-M perpetual futures and delivers structured alerts to your Telegram account. Alerts are generated by deterministic algorithms and, optionally, enriched by AI models. The service includes:
- Real-time market-structure alerts describing an observed event: the levels and structure involved, the order-flow and volume context, a conviction grade and a freshness reading. Since 21 August 2026 alerts carry no entry, stop loss, take-profit level, reward-to-risk ratio or position size on any tier.
- On-demand AI co-pilot features (
/ai,/ask,/psy,/market) that provide market interpretation and coaching, not trading instructions. - Watchlist management and informational commands.
- A free 7-day Premium trial for new users.
7. NextScalp Bot: tiers, trial and payment
- There is a free tier with limited functionality and a Premium tier with full signal access. Current pricing is shown in the bot at
/premium. We may change pricing with at least 14 days’ notice to active subscribers. - New users receive a 7-day free Premium trial, one per Telegram account. It ends automatically and no charge is applied if you do not subscribe.
- Payments are processed via Crypto Pay, operated by Telegram, in currencies including USDT, TON, BTC and ETH. By paying you also agree to Crypto Pay’s terms. We never store your wallet addresses or private keys.
- There is no recurring billing. A subscription does not renew by itself; you buy a new period when you want to continue. You may stop using the Bot at any time.
8. NextScalp Bot: refunds
Bot subscriptions are non-refundable except where required by applicable consumer protection law. If you believe you are entitled to a refund under the law that applies to you, contact support@nextscalp.com within 14 days of the charge.
9. NextScalp Bot: acceptable use
You agree not to:
- Redistribute, resell, or publicly broadcast signals or AI output from the Bot without our written permission.
- Use automated tools (bots, scrapers, scripts) to interact with the Bot beyond normal personal use.
- Attempt to circumvent quota limits, tier restrictions, or any other access control.
- Use the Bot to engage in market manipulation or any activity that is illegal under applicable law.
- Impersonate NextScalp or present our signals as your own proprietary signals to third parties.
Violating acceptable use may result in immediate suspension of your account without refund.
10. NextScalp Bot: service availability
We aim to keep the Bot available around the clock, but we do not guarantee uninterrupted availability. It may be suspended or degraded by maintenance, exchange API outages, Telegram platform issues, or circumstances beyond our control, and signal delivery depends on third-party infrastructure (Binance market data feeds, the Telegram Bot API). Delays, missed signals, or outages in those systems are outside our control and we are not liable for losses arising from service interruptions.
11. NextScalp Journal: what the software is
NextScalp Journal is self-hosted software that rebuilds your exchange futures fills (Binance USDⓈ-M or Bybit linear perpetuals) into round-trip trades and surfaces behavioral patterns in your trading. It runs on infrastructure you control. It is an analysis and record-keeping tool only.
12. NextScalp Journal: what you are buying
- A licence to NextScalp Journal, supplied as source you host yourself.
- The price is $59 USD, charged once. It is not a subscription. Nothing renews automatically, and no payment method is stored by us for future charges.
- $59 is the final amount. The seller is not registered for VAT and does not charge it, so no VAT or other sales tax is added at checkout.
- 12 months of updates from the date of purchase, as described in section 14.
- Payment is taken by Stripe on its own hosted checkout page. See the Privacy Policy for what is collected and stored.
13. NextScalp Journal: your licence
Buying the Journal buys a licence to use it. It does not transfer ownership of the software, and it is not an open-source grant. Subject to these Terms, you get a non-exclusive, non-transferable, worldwide licence to:
- Install and run the software on machines you control, for your own trading or for the trading of the single business that bought it. One licence covers one trader, not one machine: run as many instances of your own as you need - for example one per exchange, Binance and Bybit side by side.
- Modify the source for your own use, and keep those modifications private.
- Keep running it for as long as you like.
You may not:
- Redistribute, resell, publish, sublicense, or otherwise share the source, in whole or in part, in public or in private.
- Run it as a hosted or managed service for other people, or otherwise offer its functionality to third parties.
- Share your licence key or your copy of the source with anyone outside your own organisation.
Each copy we supply carries a signed licence file identifying the licensee. It is a watermark, it is deliberate, and it is checked entirely offline - it never contacts a server. Removing it, altering it, or tampering with the identifier is a material breach of these Terms and ends the licence immediately.
14. NextScalp Journal: updates, and what happens after 12 months
- A purchase includes every update released in the 12 months following it.
- Every version you received inside that window stays yours to run indefinitely. The software is self-hosted and does not stop working when the window closes: nothing expires, nothing locks, nothing is disabled.
- After 12 months, further updates are optional. Nothing is charged and nothing changes unless you decide you want them. Renewing from the download page extends your existing licence by another 12 months. Renewal costs the price current at the time, but never more than the amount of your original purchase, even if the price for new buyers has gone up since. Renewing before your window runs out adds the 12 months to its end, so you lose nothing by renewing early.
- We do not promise a release schedule, a specific feature, or continued support for any particular exchange, third-party API, or version of a dependency.
15. NextScalp Journal: your licence key
Your licence key is shown on the confirmation page you land on after paying. It is not emailed to you. There are no accounts and no passwords, so there is no password reset and no self-service recovery.
- Save the key when you see it. Keeping it safe is your responsibility, and it is your proof of purchase.
- The confirmation link contains the checkout session identifier, and anyone holding that link can open it and read your key, the purchase email, and the update expiry date. Treat the link as private.
- If you lose the key, email journal@nextscalp.com from the address you bought with and we will look it up. That is a courtesy, not an automated service, and we may decline if we cannot match the request to a purchase.
- You are responsible for use made of your licence key by anyone you give it to.
16. NextScalp Journal: refunds
14 days, no questions asked. Email journal@nextscalp.com within 14 days of your purchase and we will refund it in full. You do not have to give a reason, and we will not ask for one.
Refunding the purchase ends the licence. Once it is issued, stop using the software and delete your copies of the source. Refunding a renewal only undoes that renewal: your update window goes back to where it was, every version you received before it stays yours, and versions released inside the refunded year are no longer yours. A chargeback is treated like a refund. If you bought as a consumer in a country that gives you a statutory right of withdrawal, this policy does not reduce it - nothing here asks you to waive it.
17. NextScalp Journal: your responsibilities
- Running and securing your self-hosted install and the machine it runs on.
- Complying with your exchange's terms (Binance or Bybit) and any laws that apply to you.
- Providing and paying for any third-party services you connect (for example, your own AI provider API key for the optional AI features).
- Keeping your own backups. We hold no copy of your database and cannot restore it.
18. Third-party services
Both products depend on services we do not control: Telegram and Crypto Pay for the Bot, Stripe for Journal payments, your exchange and, optionally, an AI provider for the Journal. Your use of those services is governed by their own terms, and we are not responsible for their availability, accuracy, or actions.
19. Intellectual property
All software, algorithms, content and branding comprising NextScalp are proprietary and protected by applicable intellectual property law. Using the Bot grants you a limited, non-exclusive, non-transferable licence to use it for personal, non-commercial purposes during your subscription period. The Journal licence is the one described in section 13.
20. Warranty disclaimer
The products and this website are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that signals, trade reconstruction, metrics, or AI output are error-free. Where you buy as a consumer, mandatory statutory guarantees that cannot be excluded by law are not affected by this section.
21. Limitation of liability
To the maximum extent permitted by law, we are not liable for any trading losses, missed opportunities, or indirect, incidental or consequential damages arising from your use of or reliance on either product. Where liability cannot be excluded, it is capped as follows:
- NextScalp Bot: the amount you paid us in the 30 days preceding the event giving rise to the claim.
- NextScalp Journal: the amount you paid for the licence.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions our liability is limited to the greatest extent permitted by law. Nothing here limits liability for fraud, wilful misconduct, or anything else the law does not allow to be limited.
22. Indemnity
You agree to indemnify and hold harmless NextScalp and its contractors from any claims, losses, damages and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of either product.
23. Termination
We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision becomes legally or operationally untenable, giving reasonable notice where possible. The Journal licence also ends if you breach it in a material way, including redistributing the source or tampering with the licence identifier, and it ends if your purchase is refunded. On termination, stop using the product and delete your copies of the Journal source. The disclaimers and the limitation of liability survive.
24. Disputes and your consumer rights
These Terms do not choose a governing law and do not name a court for disputes. If you are a consumer, you keep the mandatory consumer protections of the country you live in, and you can bring a claim before the courts there. Nothing in these Terms removes that.
Please contact us first: write to support@nextscalp.com (Bot) or journal@nextscalp.com (Journal) and we will try to resolve the matter informally. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
25. Changes
We may update these Terms as the products evolve or as the law requires. Material changes are reflected by the “last updated” date above, and material changes affecting Bot subscribers are announced in the bot at least 14 days before taking effect. The Terms that apply to a Journal purchase are the ones published when the purchase was made. If you do not accept revised Terms, stop using the products.
