Terms of Service
These Terms of Service ("Terms") govern your access to and use of the NextScalp service, which includes the @nextscalp_bot Telegram bot and the nextscalp.com website (together, "the Service"). By starting the bot or using the Service in any way, you agree to these Terms.
If you do not agree, stop using the Service and, if you have an active subscription, contact us to arrange cancellation.
1. Who we are
NextScalp is operated as an independent service. Contact: support@nextscalp.com. References to "we," "us," or "our" in these Terms refer to NextScalp.
2. What the Service is
NextScalp is a real-time market-screening tool that monitors Binance USDM perpetual futures and delivers structured alerts to your Telegram account. Alerts are generated by deterministic algorithms and, optionally, enriched by AI models. The Service includes:
- Real-time signal alerts with structured trade plan information (entry level, stop loss, take-profit levels, reward-to-risk ratio) where a plan is mathematically supportable.
- On-demand AI co-pilot features (
/ai,/ask,/psy,/market) that provide market interpretation and coaching, not trading instructions. - Portfolio tracking, watchlist management, and informational commands.
- A free 7-day Premium trial for new users.
3. Not financial advice
Nothing in the Service constitutes financial advice, investment advice, trading advice, or any other professional advice. Alerts, AI outputs, signal plans, and any other content produced by NextScalp are informational in nature only. They reflect algorithmic analysis of market data at a point in time; they do not account for your personal financial situation, risk tolerance, tax obligations, or regulatory constraints.
You are solely responsible for your own trading decisions. Past signal performance does not guarantee future results. Cryptocurrency perpetual futures trading carries a high risk of loss, including the possibility of losing more than your initial margin. Trade only what you can afford to lose.
The AI co-pilot features are labelled as a second opinion and are not instructions. Their output should be treated as one data point among many, not as a directive to enter or exit a position.
4. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that:
- You are of legal age in your jurisdiction to enter into binding contracts.
- Accessing and using crypto trading tools is legal in your jurisdiction.
- You are acting on your own behalf, not on behalf of a minor.
If you are located in a jurisdiction where the distribution of crypto trading signals or related services is prohibited or regulated in a way that requires licensing we do not hold, you are not permitted to use the Service.
5. Subscriptions and payments
5.1 Tiers
NextScalp offers a free tier with limited functionality and a Premium tier with full signal access. Current pricing is displayed in the bot at /premium. We may change pricing with at least 14 days' notice to active subscribers.
5.2 Free trial
New users receive a 7-day free Premium trial. One trial per Telegram account. The trial ends automatically; no charge is applied if you do not purchase a subscription.
5.3 Payment
Payments are processed via Crypto Pay, operated by Telegram. Accepted currencies include USDT, TON, BTC, and ETH. By completing a payment you agree to Crypto Pay's terms. All prices are displayed inclusive of any applicable fees. We do not store your wallet addresses or private keys.
5.4 Refunds
Subscriptions are non-refundable except where required by applicable consumer protection law. If you believe you are entitled to a refund under applicable law, contact us at support@nextscalp.com within 14 days of the charge.
5.5 Cancellation
You may stop using the Service at any time. Paid subscriptions are not automatically renewed; you must purchase a new subscription to continue Premium access after the current period expires. There is no recurring billing.
6. Acceptable use
You agree not to:
- Redistribute, resell, or publicly broadcast signals or AI outputs from the Service without our written permission.
- Use automated tools (bots, scrapers, scripts) to interact with the Telegram bot beyond normal personal use.
- Attempt to circumvent quota limits, tier restrictions, or any other access controls.
- Use the Service to engage in market manipulation or any activity that is illegal under applicable law.
- Impersonate NextScalp or present our signals as your own proprietary signals to third parties.
Violation of acceptable use may result in immediate suspension of your account without refund.
7. Service availability
We aim to keep the Service available around the clock, but we do not guarantee uninterrupted availability. The Service may be suspended or degraded due to maintenance, exchange API outages, Telegram platform issues, or circumstances beyond our control. We are not liable for losses arising from service interruptions.
Signal delivery depends on third-party infrastructure (Binance WebSocket feeds, Telegram Bot API). Delays, missed signals, or temporary outages in those systems are outside our control.
8. Intellectual property
All software, algorithms, content, and branding comprising NextScalp are proprietary and protected by applicable intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes during your subscription period.
9. Limitation of liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" without warranty of any kind, express or implied.
- We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for any trading losses, missed opportunities, or financial damages of any kind arising from your use of or reliance on the Service.
- Our total aggregate liability to you for any claim arising under these Terms is limited to the amount you paid us in the 30 days preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
10. Indemnity
You agree to indemnify and hold harmless NextScalp and its contractors from any claims, losses, damages, and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Poland. Any dispute arising from these Terms shall first be attempted to be resolved by contacting us at support@nextscalp.com. If we cannot resolve the dispute informally within 30 days, either party may pursue resolution through the competent courts of Poland.
If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes to these Terms
We may update these Terms as the Service evolves or as required by law. Material changes will be announced via the bot at least 14 days before taking effect. Continued use after the effective date of a revision constitutes acceptance. If you do not accept revised Terms, you may stop using the Service and request a pro-rata refund of any prepaid period (if applicable under law).
13. Termination
We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision of the Service to you becomes legally or operationally untenable. We will give reasonable notice where possible. On termination, your right to use the Service ends immediately.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
